Assessify Affiliate Program Agreement
This Affiliate Agreement ("Agreement") is made and entered into by and between Assessify, Inc., a Delaware corporation ("Assessify", "we", "us", or "our"), and the Affiliate ("you", "your", or "Affiliate").
By applying for and participating in the Assessify Affiliate Program ("Program"), you agree to the following terms and conditions:
Enrollment in the Program
To begin the enrollment process, you must submit a complete Affiliate Program application via our website. We reserve the right to approve or reject any application at our sole discretion. Your participation in the Program will be governed by this Agreement once your application is accepted.
Affiliate Responsibilities
- Promote Assessify.com and its services in a lawful and ethical manner.
- Avoid making false or misleading claims about Assessify’s products.
- Only use approved marketing materials provided or authorized by Assessify.
- Disclose your affiliate relationship when promoting Assessify, in compliance with FTC guidelines.
Affiliate Links and Tracking
We will provide you with unique tracking links. You must use these links to receive credit for referred customers. We are not responsible for any failure to track users who do not follow these links or disable cookies.
Commission Structure
You will earn a commission of 2% of the amount paid for qualifying purchases made by customers who are attributed to your referral link. Each confirmed paid purchase, including a recurring subscription payment, may generate a separate 2% commission. No commissions will be paid for self-referrals, refunded payments, or fraudulent transactions.
Payout Terms
Earned commissions are recorded in the partner dashboard after Assessify confirms the qualifying payment. Assessify will confirm the payout schedule, threshold, and payment method separately before a payout is issued.
Term and Termination
This Agreement begins upon our acceptance of your application and continues until terminated by either party with written notice. We may terminate this Agreement immediately for cause, including violation of terms or any form of abuse or fraud. Upon termination, all unpaid commissions that are not yet due shall be forfeited.
Intellectual Property
You may use Assessify trademarks and materials solely for the purpose of promoting Assessify under this Agreement. All rights not expressly granted are reserved by Assessify.
Limitation of Liability
We shall not be liable for indirect, special, or consequential damages arising in connection with this Agreement. Our aggregate liability shall not exceed the total commissions paid or payable to you under this Agreement.
Independent Contractor
You are an independent contractor, and nothing in this Agreement shall be construed to create a partnership, joint venture, agency, or employment relationship between you and Assessify.
Governing Law
This Agreement shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles.
Modification
We may update this Agreement from time to time. Continued participation in the Program constitutes your acceptance of any changes.
By applying and participating in the Program, you acknowledge that you have read, understood, and agree to be bound by the terms of this Affiliate Agreement.
