A Proposition 8 property tax appeal in California refers to a request by a property owner to reduce their property's assessed value when the market value has fallen below the assessed value set under Proposition 13.

Proposition 8, passed in 1978 as an amendment to Proposition 13, allows for temporary reductions in property tax assessments when real estate market conditions cause a property’s market value to drop below its assessed value.

How It Works

  • The property owner files an appeal with the county assessor or assessment appeals board.
  • If approved, the assessed value is temporarily reduced for that tax year.
  • The assessor can increase the value in later years up to the original Proposition 13 value, plus 2% per year, if the market recovers.

This appeal must typically be filed during a specific window, usually between July 2 and November 30, depending on the county.
